Article 1 – Application and enforceability of the privacy policy

This privacy policy applies to any user of the Site.

EVS has taken the necessary measures to comply with French Act No. 78-17 of 6 January 1978 on information technology, data files and civil liberties, as amended and in its version in force, as well as with the General Data Protection Regulation No. 2016/679 adopted on 27 April 2016 by the European Parliament, and with the laws and regulations arising therefrom (the “GDPR ”).

The Privacy Policy contains all the information necessary for the User to verify and exercise their data protection rights.

Article 2 – Collection and use of the User’s personal data

When a User uses the Site, EVS may collect personal information provided by the User, namely surname, first name, date of birth, billing postal address, delivery postal address, email address, telephone number, data relating to the bank account and payment card, internet protocol address, browsing history, details of the User’s payments and orders (the “Personal Data ”).

This Personal Data is collected and used by EVS under the following conditions:

  • User’s Order

When a User creates a customer account on the Site, EVS collects the User’s surname, first name, date of birth, postal address, email address, telephone number and internet protocol address.

This data is recorded when the customer account is created and is used when the Customer makes a purchase of NUNSHEN-brand products (the “Order ”) so that EVS can record, confirm, prepare and deliver the Order to the User and, where applicable, inform them of any event relating to the Order. This data also allows EVS to maintain a commercial relationship with the User and to track the stock of NUNSHEN-brand products.

  • Payment of the Order

When paying for the Order, EVS collects the data relating to the User’s bank account and payment card in order to allow the User to pay for their Order.

  • Subscription to the newsletter

The Customer may subscribe to EVS’s news and/or commercial offers (the “Newsletter”) by entering their email address on the Newsletter link dedicated on the Site or by ticking the corresponding box when placing the Order.

Once the subscription is taken out, EVS uses the User’s email address to send NUNSHEN news (new products, events, offers, etc.). The Customer may unsubscribe from the Newsletter by clicking the unsubscribe link located at the bottom of the emails or by contacting EVS at the email address contact@nunshen.com.

  • Audience measurement

EVS collects data relating to the User’s browsing history and information on the products ordered, which is anonymised and made available to analysis tools, such as Google Analytics, in order to analyse the User’s use of the Site to better understand the User’s activity and improve performance on the Site so that it matches the User’s usage.

  • Reviews of NUNSHEN products

When the User publishes a review of their Order, the company BREVO, which specialises in customer relationship management, collects the User’s email address, surname, first name and Order reference in order to assess the User’s experience with the products ordered. The User’s email address will not be published on the Site when their review is published.

  • Advertising

Advertising cookies that collect Personal Data may be placed when the User visits the Site, to then display targeted advertising messages when the User browses other sites. The Personal Data collected is the information entered by the User in the Site’s contact form. This Personal Data is anonymous and is used only within the framework of advertising functionalities.

  • EVS contact form

When the User contacts EVS through the “Contact Us” form on the Site to submit any request or observation, EVS collects the User’s surname, first name, email and telephone number, where applicable.

This data is then used to allow EVS to send a personalised response to the User’s request.

Article 3 – Sharing of Personal Data with third parties

3.1. User’s Order

Within the framework of placing an Order, the User’s data referred to in:

  • article 2.1 of the Privacy Policy is also transmitted to EVS’s logistics providers who prepare and transport the Order to the delivery location indicated by the User. These logistics providers use this Personal Data solely to process the delivery. If the User chooses to have their Order delivered outside Europe, their Personal Data is transmitted to the logistics services of the carrier who will deliver to the User in that country;
  • article 2.2 of the Privacy Policy is also transmitted to the third-party payment service provider for the implementation of the payment services of the Order.

3.2. Subscription to the Newsletter

EVS uses the emailing tool of the company BREVO in order to send the NUNSHEN Newsletter to the User. EVS transmits the User’s email address, surname and first name to BREVO.

3.3. Audience measurement

EVS makes available to audience-analysis tools (such as Google Analytics) the User’s browsing history on the Site and information on the Orders, such as the basket amount or the number of items purchased. This data is all anonymised and handled for statistical purposes only.

3.4. Product reviews

The User’s email address, surname, first name and Order reference are transmitted to EVS’s partner, who will send the User an email containing the review form to be completed.

3.5. Merger, acquisition, asset transfer or receivership

EVS may be required to transfer or share the Personal Data in the event that it is subject to a merger, acquisition, asset transfer or receivership operation. The Customer will be informed in advance of the sharing of their Personal Data with this third-party company.

  • Legal provisions

Where the law requires it, EVS may be required to transmit the Personal Data to third parties in order to comply with administrative and judicial procedures.

3.7. Third-party privacy policy

The third-party suppliers EVS uses collect, use and disclose the User’s information for the sole purpose of carrying out the services they provide to EVS.

However, certain third-party service providers, such as payment gateways and other payment transaction processors, have their own privacy policies regarding the information that EVS must provide to them for purchase transactions.

EVS recommends that the User carefully read the privacy policies of these third parties in order to be aware of how their Personal Data is processed.

The User is informed that some suppliers may be located, or have facilities located, in a jurisdiction different from theirs or from that of EVS. Consequently, the information could be governed by the laws of the jurisdiction in which this supplier and/or its facilities are located.

When the User is redirected to the website or application of a third party, the Privacy Policy ceases to apply to the User.

EVS assumes no responsibility for the privacy practices carried out by these other sites.

Article 4 – Retention period of Personal Data

The Personal Data communicated to EVS by the User is kept until:

  • The User sends a request to delete the Personal Data, it being specified that, within the framework of the Newsletter, the request may also take the form of the unsubscription mentioned in article 1.2.2. of this privacy policy;
  • the expiry of a period of three (3) years from the User’s last activity with EVS (order, email, etc.).

Article 5 – User’s consent

5.1. Consent

When the User provides Personal Data to EVS, they consent to the collection of this Personal Data and to its use by EVS for the purposes referred to in the Privacy Policy only.

In the event that EVS wishes to use this information for other purposes, EVS must first obtain the User’s explicit consent.

  • Withdrawal of consent

The Customer may withdraw their consent by notifying EVS by email at the address contact@nunshen.com or by post addressed to EVS PROFESSIONNEL France, 18 avenue Charles de Gaulle – 69370 SAINT-DIDIER-AU-MONT-D’OR.

Article 6 – Cookies

6.1. Cookies collected

When the User browses the Site or places an Order with EVS, data may be stored in, or retrieved from, the User’s browser, generally in the form of cookies (a small text file saved by the browser of a computer, tablet or smartphone that makes it possible to collect standard information about the User, in particular to track the volume, type and configuration of traffic on the Site and improve its use).

EVS uses internal cookies placed by the Site in order to facilitate the User’s use of the Site (the “Internal Cookies”). They make it possible in particular to remember the information entered in the forms on the Site so that the User does not have to enter it again each time, but also to manage and secure access to the customer account, or to save the shopping basket.

EVS also uses audience-measurement cookies in order to assess the traffic on the Site (number of visits, page views, basket abandonment, etc.) and improve the performance of the Site. Finally, EVS uses third-party cookies that collect Personal Data to then display targeted advertising messages when the User browses other sites. The Personal Data is anonymous and is used only within the framework of advertising functionalities.

Most of these cookies cannot be disabled in EVS’s systems.

6.2. User’s consent

Internal Cookies do not require the User’s consent. The User may, however, block these cookies in their browser settings. In this case, the User is informed that certain useful functionalities of the Site, such as saving the shopping basket, may be affected.

The other cookies are subject to the User’s consent through a display banner allowing the User to view the cookies and their purposes and to consent to or refuse these cookies, globally or individually, by clicking the corresponding box in the display banner. The User’s consent or refusal is saved for a period of [__] months. The User will, however, have the possibility of withdrawing their consent at any time.

The User may also block this type of cookie on all the websites they visit, including the Site, by modifying their browser settings.

Article 7 – Disclosure

7.1. Prohibition on disclosing Personal Data

EVS may not share the Personal Data without the User’s prior consent with third parties other than those mentioned in this Privacy Policy and in article 7.2 below.

7.2. Exception

EVS may disclose the User’s Personal Data if the law obliges it to do so or if the User violates EVS’s general terms and conditions of sale, or to protect its rights, property or security as well as those of third parties.

The Personal Data may be communicated by EVS to the trusted third parties who assist it in the administration and proper functioning of the Site, namely the Site developer, the company Superweb, and the EVS employees in charge of these matters. These trusted third parties undertake to keep this Personal Data confidential.

Article 8 – Security

The Site is created using the WORDPRESS CMS and the shop management tool WOOCOMMERCE.

The Site is hosted by Kinsta (Paris datacenter).

The Personal Data is stored in the data storage system and databases of Kinsta, in France (Paris datacenter), in its capacity as data subcontractor. The Personal Data is kept on a secure server protected by a firewall.

The User’s credit card information is encrypted through the use of the SSL security protocol and kept with AES-256 encryption and compliance with the PCI-DSS standard.

It is, however, specified to the Customer that the internet is not a completely secure tool and that EVS cannot guarantee the security of the transmission and/or storage of the Personal Data on the internet and/or with the host.

EVS recommends that the User adopt the following security measures to improve their security on the Internet:

  • Use at least eight (8) characters for the password when creating the customer account with EVS, mixing letters (uppercase and lowercase) and numbers. The User is advised not to use as a password their name or other personal data that can be easily obtained;
  • Keep the customer account password confidential and avoid using the same password for several accounts.

Article 9 – Payment data

If the User makes their purchase through a direct payment gateway via their bank account, WOOCOMMERCE and/or STRIPE will store their credit card data.

All direct payment gateways comply with the PCI-DSS standard, managed by the PCI Security Standards Council, which is the result of the joint effort of companies such as Visa, MasterCard, American Express and Discover.

The requirements of the PCI-DSS standard make it possible to ensure the secure processing of the User’s credit card data. The banking information is encrypted in accordance with the PCI-DSS security standard.

The information relating to the purchase transaction is kept for the time needed to finalise the Order.

For more information, the User is invited to consult the privacy policies of STRIPE and/or WOOCOMMERCE.

Article 10 – Exercise of rights over the Personal Data

In accordance with the GDPR, every Customer has the right to information, rectification, erasure, restriction of processing, objection, and modification of the portability of their Personal Data. Consequently, the User may, at any time, access, correct, modify, update, restrict, contest the accuracy of, delete, lodge a complaint about or object to the processing of their Personal Data held by EVS, unsubscribe from the Newsletter and delete their customer account where applicable, exercise their right to transparency and to the portability of their Personal Data by contacting the person in charge of EVS’s privacy standards by email at the address contact@nunshen.com or by post addressed to EVS PROFESSIONNEL FRANCE, indicating their surname, first name, address, email as well as a copy of their identity card or passport, together with the subject and description of their request.

Article 11 – Age of consent

By using the Site, the User declares that they are at least the age of majority in their country, state or province of residence, or that they have given their consent to allow any minor in their care to use this website.

Article 12 – Changes to this privacy policy

EVS reserves the right to modify this Privacy Policy at any time. The changes will take effect immediately after their publication on the website. EVS will notify the User of each update of this Privacy Policy by email before the effective date, in particular so that the User is informed of the Personal Data and information collected, the way in which EVS uses it, and in what circumstances EVS discloses it where applicable. If the User does not agree with the terms of the new privacy policy, they have the possibility of requesting the deletion of their Personal Data under the conditions provided for in article 10 above.
